PREAMBLE

This e-commerce site, including email addresses are: www.lessensdumonde.com-and www.lessensdumonde.co.uk is edited by DS Conseil company, company limited liability capital of 1500 euros, whose registered office is at 30 Allée Eugène Delacroix - 76000 Rouen, registered with the Trade and Companies under number Rouen 507 606 044 (hereinafter the "Company").

The company offers the sale of its products on the website: www.lessensdumonde.com and www.lessensdumonde.co.uk, the consumers must have the necessary legal capacity to placing an order (hereinafter "Customer"). The Company not may be required to verify the legal capacity of each Customer.

OBJECT

These terms and conditions are intended to define the terms of sale between the Company and the Customer, the order to payment and shipping. They cover all the necessary steps for placing the order and tracking of this order between the contracting parties. These general conditions of sale apply to all orders placed on the Internet and www.lesensdumonde.com www.lessensdumonde.co.uk website orders.


2. GENERAL

Conclusion of the contract - Entry into force of the general conditions

Insofar as the Customer make an order online the products presented on the site www.lesensdumonde.com and www.lesensdumonde.co.uk the electronic signature of the Customer on the " Order Form " marks the conclusion of the contract between the Customer and the direction Les Sens du Monde. According to the law of 13 March 2000 on the electronic signature and the law on trust for the digital economy of 21 June 2004, all orders confirmed by the Customer by "double click" constitutes an irrevocable acceptance of these terms by customer, as a handwritten signature.


Contract Period

General conditions of sale are concluded for the duration necessary for the provision of products, until the expiry of their guarantees.


Document probationary

This contract contains the following contractual documents: these terms and conditions, the purchase order. In case of conflict between the two documents, the General Conditions shall prevail.


Validity of the General Terms and Conditions

The order implies the irrevocable general conditions of sale. These conditions of sale can be modified, the applicable conditions are those in force on www.lessensdumonde.com the date of placing the order by the Customer.


Products
The products offered by Company conform to the french legislation and standards applicable in France.

Les Sens du Monde, the store reserves the right to modify the selection of products offered on the site www.lesensdumonde.com and www.lessensdumonde.co.uk at any time and without notice.

The products offered for sale are described and presented with the greatest possible accuracy. However, if errors or omissions were to occur in this presentation, the responsibility for Company could not be committed. The photographs and texts illustrating the products are indicative only and are not included in the contract. The Customer's attention is particularly drawn to the fact that the colors shown on the product pictures may not provide an exact similarity with the actual colors.


Availability
The products are offered for sale within the limits of available stocks.
A lack of availability of the product in any way responsible for Company can’t be held, or entitlement to damages to the Customer. However, Company agrees to inform the Customer as soon as possible and to propose a similar product, a refund or a credit on account of all products.

If the customer opts for a refund, Company will make its best effort to reimburse the Customer within 30 days of the date on which Company has informed the Customer of the unavailability of the product. Company will ship all other products of the order.


Products on order or under supply

Some products are marked "available... days, "the time indicated is only an indication, it is a period generally respected, meaning that the product is in inventory.

Orders are shipped when they are complete. So if an order contains products and products in inventory, the order will be shipped only when all products will be in stock. In this case, we advise customers to place two separate orders: one for the stock and other related products in inventory.



3. PRICE

The prices of products sold on the site www.lesensdumonde.com are indicated excluding the cost of shipping and are valid as long as they are present in the description of the product.

Company reserves the right to change prices at any time.

Company can’t be held liable for any obvious typographical error. If such an error occurs, Company will inform the Customer as soon as possible. The order will be charged to the conditions corrected. In case of refusal of corrected conditions, the Customer may cancel the order without penalty.



4. ORDER

All orders placed with Company is intended for the personal use of customers, Customers or recipients of the products is strictly forbidden partial or complete products.


Capacity
Only persons legally capable of entering into contracts for the products offered on the site www.lesensdumonde.com and www.lessensdumonde.co.uk can order. When placing the order, the Customer shall have full legal capacity to adhere to these terms and conclude this agreement.



Personal Information

When ordering, the Customer agrees to provide the information requested of it and commits to the accuracy of the latter: name, address, phone, email address.

Customer must verify all information entered in its Order. If after confirmation of the order, the Customer is aware of the need to change some information, it may do so by contacting Company by email within 12 hours for the request to be taken into account in the best conditions.

Company can’t be held responsible for any errors entered by the customer or the consequences in terms of delays or misdelivery.


Mail confirmation of the order

It is expected, after the registration of the order, sending an e-mail to the Customer. This email confirms that the customer order was taken into account by Company and not the ordered product is available.

Order processing orders are processed in order of their arrival, the processing time is usually found 12 to 48 hours (excluding weekends and holidays).

Company reserves the 24h time to possibly indicate its inability to meet the demand of the customer.
In this case, Company reserves the right to ask the customer to modify his order. Les Sens du Monde, the shop is committed to process all orders within the limits of available stocks.


Non-execution of the order

Company can’t be held liable for breach of contract in case of shortage or unavailability of the product, force majeure, disruption or total or partial strike of postal services and transport strike responsibility communications (computer network failure etc..), flood, fire...


Responsability
Les Sens du Monde, the store can’t be held liable to the Customer or any third party for any indirect damages, any loss of profit or revenue, or for any loss of data occurred in any way either.



5. PAYMENT

The site Les Sens du Monde, the shop offers several methods of payment :

  • Credit card (Visa and MasterCard ) : Les Sens du Monde chooses to secure your credit card payments with the 3D Secure system Elysnet. Transport security card data is provided by 128-bit  SSL (Secure Socket Layer) ; encryption and payment page is hosted on a server bank that ensures the integrity and confidentiality of data. Company was never aware of any data on credit cards.
  • Paypal : If you have a Paypal account, you can use this payment method. It is then the terms and conditions that apply Paypal.
  • Check (only France): You send the check to the address which will be communicated by email. The order will be processed upon receipt of payment.                
  • Bank Transfer : You make a transfer to the bank account details communicated to you by email. The order will be processed upon receipt of payment.

Access to the invoice

The order that the Customer establishes online or order confirmation sent by email to the Customer by Company is not your invoice. The invoice is enclosed. Company keeps a copy of each invoice.


Default
Company also reserves the right to refuse to make a shipping or an order  from a customer who has not fully paid a previous order or with whom a dispute is not resolved.


Confirmation of payment

Orders are payable in euro only.

Confirmation of payment by Company can ship packages to the address indicated by the Customer in the order.
To reduce the risk of fraud, Company may need to carry out checks on the validity of payments made.



6. SHIPPING

Shipping terms

Except as otherwise provided in these Terms and Conditions, the shipping costs  are always the responsibility of the Customer
The products must be delivered to the address specified by the customer when entering information in the order.
The invoice is included in the package.


Shipping methods

We suggest that you send your package with the following carriers :

  • in pickup point with Mondial Relay or similary
  • at home with La Poste (Colissimo) or similary TNT, Happy Post, DHL

Order processing time

Orders are processed in order of arrival, usually found within 24 to 48 hours (excluding weekends and holidays).


Prices, times and delivery areas

See the table " Prices and delivery by zone" on page shipping terms.

Time to count the support by the carrier (following the processing time of order). Time for information, no carrier is committed to the delivery time.

For deliveries outside mainland France, the Customer agrees to pay all taxes due to the importation of products, customs duty, value added tax and other taxes due under the laws of the country receiving order.
From 01/01/2021, a minimum order of 150 € (i.e. £ 135) is applied for the Customer from United Kingdom. Invoices are exclusive of VAT. UK VAT and customs duties are collected from the Customer.

The Customer is fully responsible for the choice of the carrier among those offered by Company.
Choosing a carrier delivering the package against signature is highly recommended. 
In no event shall Company can’t be held responsible for a flight that would take place during the shipping of the package (after taking over by the carrier) or in the mailbox of the customer. The choice of shipping mailbox is risk acceptance by the Customer. (Our statistics: In 0.2% of cases, when a shipping mailbox (Colissimo Access), the Customer has indicated that the package had not reached him as the carrier stated that it had delivered. In contrast, 100% of packages successfully delivered to customers who choose a carrier delivering the package against signature.) 
On request, we provide evidence that the package has been entrusted to the carrier selected in your order (deposit slip stamped number or support) except for Max Letter (no tracking). 


Shipping receipt 

Transport risks are borne by the Customer from the management of the parcel by the Carrier. 
The Customer must check the condition of the packaging and the compliance of the product delivered and issue if necessary, on the Shipping of the carrier.
In the case where the carrier is the Post Office, the procedure to be followed to qualify for the right of return is as follows : 

- Application of the procedure Colissimo and refusal of goods immediately putting a finding of fault with the attendant post 

- Reporting of refusal of Shipping from Company within 24 hours from the date of shipping 

The absence of complaints within 24 hours, non of reservations from the Customer means that the product supplied is deemed satisfactory and will not be subject to any subsequent dispute. 

Company can’t be held responsible for the consequences of any delay in shipping. 

In case of non receipt of a package in a timely indication, the Customer may contact Company will determine the cause of the delay and shall submit to the Customer.

Shipping / Instance

1 / Colissimo: in case of absence, a notice of registration is left in the recipient's mailbox. You then have 15 days to collect your package in the nearest post office. After 15 days, if you have not claimed your package, it will be automatically returned to the sender. Delivery charges will be invoiced for a new shipment. Otherwise, the package is lost. Attention: For the countries of zone Z3 to Z6 see Delivery), the return of the parcel is paying and will be invoiced in addition to the costs of re-dispatch.
2 / Mondial relay: tracking of the routing from the link communicated to the parcel shipment, Mondial Relay notifies by e-mail and / or sms the arrival of the package in relay point. The parcels remain available for 14 days before being returned to the dispatcher. Delivery charges will be invoiced for a new shipment. Otherwise, the package is lost.
3 / TNT or other carrier: follow-up of the routing from the link communicated to the shipment of the parcel. In case of absence, a notice of passage is left in the mailbox. Contact the carrier immediately. In case of no claim, a return fee will be charged in addition to the re-shipment fee.


Right of withdrawal and right of return 

Pursuant to Article L.121-21-8 of the Code of consumption, the opening beauty products (cosmetics and makeup) making these unsuitable products to any further marketing, Customer has no right of withdrawal and any cosmetic product that has been opened, damaged or whose original packaging has been unsealed, will not be refunded, returned or exchanged, for reasons of hygiene and protection health.

Subject to the exceptions set out in Article L.121-21-8 of the Consumer Code and in particular that outlined in the preceding paragraph, the Customer has, in accordance with Article L.121-21 of the Consumer Code, a period of 14 days from receipt of the Product to exercise his right of withdrawal. When the period of 14 days falls on a Saturday, Sunday or a holiday or holiday, it is extended until the next business day.


Procedure for returning a product 

The right of return may be exercised in the context of a change of mind (14 days from receipt of the product), a Company error.

The Customer may exercise his right of withdrawal by printing and completing the withdrawal form or by email or by mail to the address of the Company.

The Customer must return the Product without undue delay and at the latest within 14 days of the communication of its decision to withdraw at the following address:

Products must be returned undamaged, in resalable condition, in original packaging and not have been opened. It must not have been worn or used, nor have suffered any damage, be it and in a state of perfect cleanliness. 
Any product that is damaged, incomplete, or whose original packaging is damaged, will not be refunded or exchanged.
The risks associated with returning the Product are transferred to the Customer. If the product is lost by the carrier when the shipment, the Customer is solely responsible for and shall not be reimbursed by the Company.

To avoid disputes, it is highly recommended that the Customer wishes to exercise his right of withdrawal in returning the product in similar package to the initial mailing (Colissimo POST) conditions with a declared value equal to the price of the initial order, and keep all proof of sending (parcel number) to return his order.
The Company does not accept parcels sent freight collect, nor against reimbursement or in relay points.
The Company reserves the right to refuse any returns sent beyond the legal withdrawal period.

In case of exercising the right of withdrawal in accordance with the conditions specified above, the Customer will be offered either an credit or a refund of the purchase amount (shipping costs "go" are reimbursed only if return of the entire order). The Company is not required to pay additional fees if the consumer has expressly opted for a more expensive than the standard delivery method proposed by the professional mode of delivery.

Return costs are refunded to the Customer when the return originates from a mistake on the part of the Company. The Customer will then propose either a credit or a refund of fees ports it has committed. If the Client chooses the refund, the Company shall reimburse the Client within a maximum period of 14 days after receiving the returned package.



7. LAW 

General conditions of sale Company will be executed and interpreted in accordance with French law. 
In case of dispute or claim, the customer should first contact Company for an amicable solution. Any dispute that may arise in their validity, interpretation or enforcement will be submitted to the competent courts headquartered in Company depends. 
In the event that any provision of the Terms is held to be illegal or unenforceable by a court, other provisions of the said conditions remain in effect.   



8. INTELLECTUAL PROPERTY 

All content (texts, comments, works, illustrations, images, videos, graphics, sound... including the underlying technology used) displayed on this website is under copyright and that under the intellectual property and worldwide. For this reason and in accordance with the provisions of the Code of Intellectual Property, the only use for private use is permitted, subject to different rules even more restrictive code of intellectual property. Any other use constitutes infringement and is punishable under the Intellectual Property without the prior authorization of Les Sens du Monde, the shop. Any total or partial reproduction of this company Les Sens du Monde, the store is strictly prohibited.   



9. MAJOR FORCE 

Neither party will have failed in its contractual obligations, insofar as their execution is delayed, hindered or prevented by a fortuitous event or force majeure. Be considered fortuitous event or force majeure any compelling facts or circumstances, outside parties, unpredictable, unpreventable, independent of the will of the parties and can not be prevented by them, despite all reasonable efforts. The party affected by such circumstances shall notify the other as soon as possible following the date on which it becomes aware.



10. PRIVACY

Personal data collected on this website will be stored and used in accordance with the law of 6 January 1978 relating to information technology and civil liberties. Users of this site have the right to access, rectify and delete data concerning them that they can exercise that they can exercise by contacting Les Sens du Monde.
